Please read this document carefully By accepting the User Terms below you will enter into an agreement with The Children?s Bookcase Limited for the provision of online services in accordance with those terms. |

1. Scope of the Service
The Children?s Bookcase web site located at www.thechildrensbookcase.com (the "Site") is owned and operated by The Children?s Bookcase Limited ("we", "us" or "out"). We will provide you with the online services available from time to time on the Site, which in any event shall include the use of children?s books and audio tapes (the "Products") searchable databases, reviews of such products and the ability to purchase Products online (the "Service"). To use the Service, you are required to register as an authorised user on the Site. Use of the Service (excluding purchases made via the Site) will be free of charge. There is no specific time limit applying to your use of the Service. However, we reserve the right to suspend or terminate your use of the Service at any time. We may exercise this right with or without notice. If applicable, notice will be given via the e-mail address provided by you on registration. In that event, notice will be deemed to be served three hours after transmission.

Use of the Service for any of following purposes is strictly forbidden:
You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out of or in connection with: (a) any claim by any third party that the use of the Service by you is defamatory, offensive or abusive, or of an obscene or pornographic nature, or is illegal or constitutes a breach of any applicable law, regulation or code of practice; (b) any claim by any third party that the use of the Service by you infringes that third party?s copyright or other intellectual property rights of whatever nature; and (c) any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with the use of the Service by you.

To the full extent allowed by applicable law, you agree that we will not be liable to you and/or any third party for any consequential or incidental damages (including but not limited to loss of profits, loss of privacy and loss of data) or for any other indirect, special or punitive damages whatsoever that arise out of or are related to the Service. Nothing in this Agreement will restrict a party?s liability for death or personal injury resulting from that party?s negligence. You agree that your only recovery for any damages that you incur, and your exclusive remedy, shall be limited to the direct damages you actually incur as a result of your use of the Service up to a limit of £500.

The information that you provide about yourself to us will only be used in accordance with our Privacy Policy. Such Privacy Policy does not apply to web sites operated by third parties.

All information about the Products and prices is subject to change without notice to you. We do not promise that Products are necessarily available, and all goods are offered for sale subject to availability. All prices displayed are quoted in UK Pounds Sterling, and must be paid in full, together with any applicable delivery charges. You will be responsible for all and any import duties and local taxes. You may pay by any Visa™ or Mastercard™ credit card, or Switch™ or Delta™ debit card. We will not deliver goods to you if you do not pay for your order in full (including delivery charges). You have fourteen (14) working days from the date of receipt of a product to cancel the contract. You may return the Product (except for audio recordings where you have broken the seal, subject to this clause 9) for a full refund, although you will be liable for the cost of the return delivery. Further, you can return any faulty Product bought from this website unused, with its wrapping and receipt, for a full refund. To return any product, faulty or otherwise, you must contact admin@thechildrensbookcase.com, specifying your complaint or issue, we will then give you a returns code and an address to which you may send the product.
10. Choice of Law and Jurisdiction

If any provision of these User Terms is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of these User Terms, which shall remain in full force and effect. Failure by either party to exercise any right or remedy under these User Terms does not constitute a waiver of that right or remedy. Heading in this Agreement are for convenience only and will have no legal meaning or effect.
